The jury had already recommended the death penalty by 11 votes to 1 in July last year. Nealy had pleaded guilty to three counts of first-degree murder.

Prosecutors maintained that the crimes occurred in December 2018 to eliminate possible witnesses to the previous murder of his wife, Jaime Ivancic. Nealy was serving a 30-year sentence for manslaughter in her death.

Sentence given in court

The judge imposed a death penalty for each victim. The sentences relate to the murders of Richard Ivancic, Laura Ivancic and Nicholas Ivancic. The sentencing hearing lasted approximately 15 minutes. Nealy remained expressionless upon hearing the decision.

Arguments of the prosecution and defense

The defense presented more than 40 mitigating circumstances. Entre They had a history of mental health, traumatic upbringing, brain injuries and displays of remorse. The judge recognized these elements, but concluded that the aggravating factors outweighed the mitigating factors.

Reactions from families after the decision

Two biological children from Jaime Ivancic attended the hearing. Rich Ivancic, the eldest son, spoke to the press after the sentencing. Ele said justice has been done and the family will get some relief. Rich was the one who requested the welfare check in 2018, which led to the discovery of the bodies.

The biological sister of Jaime, Karma Stewart, provided an impact statement via video conference. Ela remembered that his sister’s death shattered the family’s world. Karma described Jaime as a kind and strong mother who should be raising her children.

Nealy made no statement when the judge asked if he had anything to say. Defense lawyers filed a request for a new trial.

Next steps in the process

Nealy will be transferred to Flórida at Departamento Correcional. The case will undergo automatic review at Supremo Tribunal at Flórida. Execution only occurs after all appeals have been exhausted.
