Malafaia criticizes Justice Moraes’ conduct, alleging dictatorial actions and STF’s desmoralization in 2025

Pastor Silas Malafaia has recently intensified his criticisms against Justice Alexandre de Moraes of Brazil’s Supreme Federal Court (STF), asserting in early 2025 that Moraes acts as a “dictator in a toga.” Malafaia’s remarks, delivered during a conservative rally in São Paulo, highlighted the ongoing “fake news” inquiry led by Moraes, which the pastor labeled “immoral and illegal,” contending it has led to a significant “desmoralization” of the high court. These accusations underscore deep-seated tensions within Brazil’s political landscape, reflecting persistent concerns among certain factions regarding judicial overreach and the balance of power, particularly in the wake of recent political upheavals.

The evangelical leader accused Justice Moraes of establishing “crimes of opinion” within a democratic state, a move he described as a “disgrace” and an “absurdity.” Malafaia argued that the initial purpose of the inquiry was to shield STF ministers implicated in controversies, thereby expanding its scope beyond legitimate judicial oversight.

His commentary during the São Paulo demonstration resonated with a segment of the public that views the judiciary’s role as increasingly interventionist, sparking further debate on the boundaries of free speech and judicial authority.

“Dictator in a toga” and contentious inquiries

Malafaia explicitly targeted Justice Moraes, stating, “This inquiry was opened to protect STF ministers who were entangled. Who commands the inquiry? The dictator in a toga: Alexandre de Moraes.” He further contended that Moraes, through this investigation, has created a precedent for the “crime of opinion” within Brazil’s democratic legal framework, a move Malafaia considers profoundly antithetical to democratic principles.

The pastor’s strong denouncement highlights a recurring point of contention regarding the judiciary’s mandate and its impact on freedom of expression, fueling public discourse on judicial impartiality and the limits of power. These allegations continue to be a focal point for critics of the Supreme Court’s current direction.

Allegations surrounding Justice’s spouse

Further escalating his attack, Malafaia brought up the case involving the Banco Master and the law firm of Viviane Barci de Moraes, Justice Moraes’ wife. He demanded clarity on the substantial contract between the bank and the law firm, suggesting it represents an illicit arrangement. The pastor explicitly called for Viviane Barci de Moraes to be summoned before Congress to provide explanations regarding the contract, advocating for her financial secrecy to be waived for public scrutiny.

Malafaia alleged, “Moraes’ wife has a R$129 million contract with Banco Master. To do what? Nothing. She has already received approximately R$50 million. Do you know what this means? Flagrant corruption. A purchase of Alexandre de Moraes’ power.” These accusations, if proven, would signify a severe breach of ethical conduct, raising profound questions about judicial integrity and potential conflicts of interest at the highest levels of the Brazilian judiciary. Justice Moraes has yet to publicly address these specific claims, intensifying calls for transparency.

Calls for congressional scrutiny

The pastor also stated that Justice Moraes has not come forward to clarify what Malafaia termed an “immorality.” This perceived lack of transparency from Moraes himself has only served to embolden his critics, who demand public accountability and thorough investigation into these serious allegations. Malafaia’s call for congressional action underlines a desire to move the debate from public rallies to official legislative oversight, aiming to compel answers through formal channels. The push for congressional hearings and the breaking of Viviane Barci de Moraes’ secrecy demonstrates a strategic effort to scrutinize the financial dealings and potential influence peddling associated with the judiciary, reflecting a broader demand for integrity in public office.

Discrediting the Supreme Court

Malafaia asserted that the STF’s decision, led by Moraes, to open an investigation into the leakage of confidential data belonging to Supreme Court ministers is a “desmoralization” for the institution itself. He challenged the procedural legitimacy of such an inquiry, arguing that if any breaches of ministerial confidentiality occurred, the STF’s president, Justice Edson Fachin, should initiate the investigation, not Moraes. This critique highlights a perceived internal conflict of interest and questions the court’s leadership in maintaining its own standards of justice and impartiality.

The pastor’s statement, “Look at the absurdity, a desmoralization for the STF, and a desmoralization for the president of the STF, Minister Fachin, if there was a breach of secrecy of ministers – which I do not agree with breach of secrecy of anyone, of family members – the one who has to open the inquiry is the president of the STF,” underscores a significant concern regarding institutional integrity and proper governance.

This perspective from Malafaia suggests a deeply held belief that the Supreme Court is failing to uphold its own procedural rules, thereby undermining its credibility in the eyes of the public and the legal community.

Demands for ministerial removal

In a direct challenge to Justice Fachin, as the presiding president of the STF, Malafaia urged him to take decisive action against Justice Moraes and Justice Dias Toffoli. Malafaia unequivocally stated, “Mr. eminent president of the STF, Minister Fachin, if you do not take the lead on this, you are desmoralized. It is better to ask them to leave the STF and let Moraes commit his crimes and his absurdities.” This forceful declaration signals a critical juncture, where the internal leadership of the STF is under immense pressure to address these persistent allegations or risk its own legitimacy.

Widespread conservative mobilization

The recent rally in São Paulo, where Malafaia delivered his impassioned speech, was part of a broader “Acorda Brasil” (Wake Up Brazil) initiative. This movement united conservative political leaders, parliamentarians, and prospective presidential candidates from the right-wing spectrum. Similar demonstrations took place in over 20 cities across the country, indicating a coordinated effort to amplify specific political messages and mobilize public support.

The central themes of these rallies consistently include strong criticisms of the current government, led by President Luiz Inácio Lula da Silva (PT), and pointed attacks against the actions of certain STF ministers. Participants voiced concerns over governmental policies and judicial decisions, reflecting a significant ideological divide within the nation.

A key demand at these events is the call for amnesty for former President Jair Bolsonaro (PL), who was condemned to 27 years in prison for his alleged role in attempting a coup after the 2022 elections. This persistent call for amnesty underscores the deep political polarization and ongoing legal battles stemming from the last presidential election cycle.

These gatherings signify an active and organized opposition movement, leveraging public platforms to press for specific political and judicial changes in Brazil, particularly as the nation heads further into the 2025 political calendar.
