The Brazilian social security system maintains strict and specific criteria for granting benefits to professionals who work in environments that are extremely harmful to health. Current legislation ensures that workers exposed to highly dangerous physical, chemical or biological agents can request paid rest with a significantly reduced length of service compared to other job categories. The main focus of this protective measure is on activities carried out underground, where the risks of accidents and the development of chronic occupational diseases are high.
For this restricted group of policyholders, the required contribution period is only 15 years. The drastic reduction in the necessary working period reflects the state’s recognition of the accelerated physical exhaustion and imminent dangers that these environments provide throughout professional life.
The measure covers seven specific functions linked to mineral extraction and underground works. The objective is to remove the worker from harmful exposure before irreversible damage to health, such as severe lung problems or hearing loss, is definitively consolidated.
Activities covered by the social security standard
Previdência Social clearly defines which occupations meet the maximum risk criteria, allowing early exit from the job market. Estas functions are intrinsically linked to the operation on underground mining fronts and require permanent contact with the subsoil.
The seven professions that guarantee this right include:
• Britador: Profissional responsible for operating rock crushing machines, working in environments with high concentration of silica dust and extreme noise.
• Carregador of rocks: Trabalhador that handles and transports extracted materials, facing intense physical effort and risks of collapse.
• Cavouqueiro: Encarregado of manual or mechanized excavations to open tunnels and galleries in search of ores.
• Choqueiro: Especialista in the assembly of containment and safety structures to prevent collapses in mines.
• Mineiro underground: Função general that covers direct extraction at the work front, under conditions of heat, humidity and adverse pressure.
• Operador of underground crusher: Manuseia high-impact vibratory equipment for fragmenting rock masses.
• Perfurador of rocks in caves: Opera drilling machinery to enable the exploration and detonation of mineral areas.
Age requirements and transition rules
Reforma of Previdência, in force since November 2019, changed the dynamics for granting this benefit, establishing different criteria for those already in the job market and for new insured people. Simply counting length of service is no longer the only determining factor in most cases, requiring attention to pension planning.
For workers who entered the system after the reform, it is necessary to cumulatively comply with the contribution period and a minimum age. In the case of a special 15-year retirement, the insured must have reached 55 years of age. Esta requirement aims to balance public accounts, although it generates debates about the physical capacity to remain underground for this age group.
For those who had INSS membership before the legislative change, the points transition rule applies. The calculation adds the worker’s age to the contribution time. Para for high-risk activities, it is necessary to reach 66 points, and it is mandatory to prove at least 15 years of effective exposure to harmful agents.
Mandatory technical documentation
Proving the special activity is the most critical stage of the administrative process with Instituto Nacional of Seguro Social. X__NM2____ It is essential to present technical reports that describe in detail the work environment and the risks faced.
The main document is Perfil Profissiográfico Previdenciário (PPP). Este form must be completed by the company based on Laudo Técnico of Condições Ambientais of Trabalho (LTCAT), signed by an occupational safety engineer or occupational doctor. The PPP must list the harmful agents (physical, chemical or biological), the intensity of exposure and the effectiveness or otherwise of Equipamentos of Proteção Individual (PPE).
The absence or incorrect completion of these documents is the main reason for application rejections. The insured must request the PPP from the companies where he worked at the end of each contract or when submitting his retirement application.
Health risks and benefit justification
The reduction in contribution time to 15 years is not a privilege, but compensation for potential damage to physical integrity. The underground mining environment presents a lethal combination of unhealthy factors that harm the body in different ways.
Exposure to mineral dust, especially silica, is the cause of silicosis, a progressive, incurable lung disease that hardens the lungs and makes breathing difficult. Além Furthermore, the constant noise from machines confined in galleries causes irreversible sensorineural hearing loss.
Other factors include whole-body vibration, which causes damage to the spine and joints, and exposure to substances such as radon and heavy metals. The legislation understands that keeping the worker in these conditions for the common regulatory period (30 or 35 years) would result in severely compromised survival quality or premature death.
Procedures for digital request
The INSS modernized the application system, allowing the entire process to be initiated remotely, without the need for immediate in-person scheduling. Digitization aims to speed up analysis and facilitate policyholders’ access to their rights.
To request the benefit, the worker must access the “Meu INSS” platform, available via the website or mobile app. When Após logs in with the account Gov.br, you must select the option “New Pedido” and search for “Retirement by Tempo of
During the procedure, the system will request the digital sending of supporting documents, such as the PPP and Carteira of Trabalho. It is essential that the images are legible. Após the submission, the insured can follow the progress of the analysis through the same channel, checking whether there is a need to comply with requirements or schedule a federal medical examination to validate the alleged conditions.
