Player Rafa Mir receives eight and a half year sentence for sexual assault and bodily harm in Valencia, pending appeal
A court in the city of Valencia, Spain, imposed a sentence of eight and a half years in prison on football player Rafa Mir, due to crimes of sexual assault and bodily harm. The information was released this Monday by the Superior Court of Justice of the Valencian Community, detailing the decision of the Fourth Section of the Provincial Court.
Additionally, the court ordered a second sentence for another defendant involved in the case, fellow player Pablo Jara. He received a sentence of two and a half years in prison, in addition to a fine, for offenses of sexual assault, violation of moral integrity and a lesser crime of bodily harm.
Despite having already been notified to the parties involved, the judicial decision is not yet definitive. It also provides for the payment of compensation of 64,000 euros to the victim in the Rafa Mir case and 6,280 euros to the complainant in the case against Pablo Jara. The possibility of appealing to higher courts demonstrates that this is an important, but not final, step in a legal process that has impacted athletes’ careers.
Football player Rafa Mir denies accusations and announces appeal against conviction
With a contract valid with Elche until the end of June and having played for the club in the current season, footballer Rafa Mir released a brief statement through his digital platforms. In his statement, the athlete declared that he did not agree with the sentence handed down and informed that he would file an appeal in the coming days, reaffirming his faith in the judicial system.
“I disagree with the sentence and we will appeal in the coming days. I continue to have faith in justice.”
The judicial resolution was announced after the end of the trial, which took place on May 28 at the Provincial Court of Valencia. During the period in which the incidents occurred, on September 1, 2024, Mir was playing for Valencia, on loan from Sevilla. He was prosecuted for sexual assault and physical injury against a young girl, charges that initially led the prosecution to request a sentence of ten and a half years in prison.
However, the court set the final sentence at eight and a half years, with seven years specifically for sexual assault and 18 months for physical assault. In addition, a restraining order was ordered that prevents the defendant from approaching the victim at a distance of less than 500 meters for a period of ten years. The victim also received compensation of 14,000 euros for material damage and 50,000 euros for emotional distress.
As regards Pablo Jara, the sentence totals two years in prison for sexual assault and a further six months for a crime against moral integrity, plus a fine, considering the facts proven in relation to a second woman.
The reconstruction of the events that led to the conviction
The episodes that culminated in the conviction date back to the early hours of September 1, 2024. The incidents took place at the football player’s residence, located in a luxury condominium in the Valencian town of Bétera, very close to the sports city of Valencia.
According to the testimony validated by the court, both complainants had met the defendants hours before in a nightclub in Valencia, later heading to the athletes’ home. The main victim declared, both during the investigation phase and during the trial, that Rafa Mir committed two rapes, one in the pool area of the residence and the other inside a bathroom.
On the other hand, the second complainant reported that Pablo Jara touched her without permission, and that he then attacked her and threw her out of the house, half-naked. The court considered that these facts constituted crimes of sexual assault, against moral integrity and minor bodily injuries.
The versions presented by the defense during the trial
Throughout the hearing, Rafa Mir refuted all accusations of aggression, arguing that all meetings took place consensually. Both he and Pablo Jara, together with a defense witness, presented statements indicating that the two victims had an initial argument after the football player kissed one of the women in the nightclub, but that, upon arriving at the residence, there was consensual sexual relations, as acknowledged by the woman herself.
After this initial consensual contact with one of the women, Rafa Mir’s testimony indicated that he had two other sexual encounters that were also consensual, one in the pool and the other in the bathroom. However, the complainant described scenes of violence and lack of consent, stating that she had asked for the actions to be stopped and had experienced fear and anxiety during the incidents.
The Court decided to validate the victims’ narrative, to the detriment of the defendants’ defense arguments, which resulted in the sentence now published.
Developments and future of the legal process
It is important to highlight that the judicial decision is not definitive and is subject to appeals to be presented in higher courts, as explained by the Superior Court of Justice of the Valencian Community (TSJCV).
With this deliberation, the court closes the first instance phase of a case that began with the arrest of the two footballers in September 2024. This process has stood out as one of the most important in the judicial and sporting spheres in the Valencian Community in recent years.
