INSS disability benefit: find out who can request disability retirement now

The Instituto Nacional of the Seguro Social (INSS) ensures the payment of the Benefício per Incapacidade Permanente, popularly known as disability retirement, to workers who become permanently unable to carry out their work activities. The grant is linked to a rigorous medical evaluation and compliance with specific criteria established by social security legislation, aiming to guarantee financial support to those who can no longer support themselves through work.

The benefit request has been modernized and is now carried out entirely through digital channels, mainly through the Meu INSS portal and application. Essa platform centralizes the sending of documents and scheduling of assessments, eliminating the need for initial trips to agencies. Proof of incapacity, however, continues to depend on an in-person medical examination, a decisive step in approving the request.

What are the essential requirements for the benefit

The first step to request disability retirement is to access the Meu INSS platform, available via the website or mobile app. Access requires an account on the Gov.br portal, with a silver or gold security level being recommended to have access to all features, including electronic signature of documents. Within the platform, the insured must search for the option “Order Benefício for Incapacidade”. The federal medical examination is the most crucial moment in the entire process of applying for permanent disability benefits. It is in this assessment that an INSS expert doctor analyzes the applicant’s health condition in depth to determine whether the incapacity is total, permanent and whether it prevents him from carrying out any work activity, not just his usual role. The expert also assesses whether there is the possibility of professional rehabilitation for another role. The expert’s decision is sovereign and based not only on the analysis of the documents presented, but also on a clinical examination carried out on the day of the evaluation. Therefore, it is essential that the insured attend the examination with all their original exams and reports, organized chronologically, to facilitate analysis and prove the evolution of the disease. The absence of clear and conclusive documents is one of the main causes of requests being rejected, as the expert needs robust evidence to attest to a disability that will justify a lifetime benefit.

How the retirement amount is calculated

After the 2019 pension reform, the calculation of the benefit value was changed.
