Tribunal of Roma accepted the action brought by Movimento Consumatori against Netflix Itália and declared null the contractual clauses that allowed unilateral changes in subscription prices and other terms between 2017 and January 2024. The judges understood that these provisions violated the Código from Italian Consumidor for not providing adequate justification. The ruling determines refunds to affected subscribers, as well as a reduction in current monthly fees and publication of the decision in media outlets.
The decision covers adjustments applied in the years 2017, 2019, 2021 and November 2024, with the exception of contracts signed after January 2024. The judges considered these price changes illegitimate and abusive. Consumidores who maintained continuous subscriptions during the period may request the return of amounts unduly paid.
Unilateral increases considered abusive
The unilateral readjustments in the plans of Netflix were applied without the contract indicating justified reasons for the changes. Essa practice was challenged in court by Movimento Consumatori, which represented the interests of Italian users.
The ruling establishes that the clauses in question are vexatious and, therefore, invalid. Como result, the streaming platform must adjust current prices to eliminate increases declared illegal.
Plans Premium, Padrão and Básico were impacted by adjustments over the years. A subscriber Premium since 2017, for example, may be entitled to a refund of approximately 500 euros. Já on plan Padrão, the estimated value reaches around 250 euros, depending on payment history.
Refunds and price reductions provided for in the decision
Each affected consumer will have the right to the refund of overpaid amounts, an immediate reduction in the current monthly fee and possible compensation for damages. Netflix still needs to inform all customers, including those who canceled their subscriptions, about the invalidity of the clauses and the right to a refund.
The company was obliged to publish the full content of the ruling on its official website and in the main national newspapers Itália. Essa measure aims to ensure wide dissemination among users impacted by the court decision.
Lawyers who worked on the case highlighted that the accumulated illegal increases currently represent 8 euros per month in plan Premium and 4 euros in plan Padrão. Para in plan Básico, the adjustment of 2 euros applied in October 2024 is also included in the calculation.
Estimated impact on millions of subscribers
Netflix had approximately 1.9 million customers on Itália in 2019 and reached approximately 5.4 million in October 2025, according to data cited by representatives of Movimento Consumatori. The court decision could affect a large number of users who maintained active subscriptions during the questioned period.
Subscribers Premium who currently pay 19.99 euros per month and activated the service in 2017 will have the amount reduced to the equivalent of 11.99 euros, according to the example provided in the action. In plan Padrão, the current value of 13.99 euros would fall to 9.99 euros after the elimination of increases considered abusive.
Movimento Consumatori warned that if Netflix does not immediately comply with the price reduction and refunds, a collective action will be initiated to ensure the rights of all consumers involved. The company has already expressed its intention to appeal the sentence.
Details about the publication of the decision
The ruling determines that Netflix formally communicates the invalidity of the clauses to all affected consumers. Essa Communication must occur in a clear and accessible manner, including for former subscribers who may still be entitled to a refund.
Reimbursement amounts vary depending on the plan contracted and the length of continuous membership. The calculations take into account the increases accumulated over the years and the retroactive application of the nullity of the clauses.
Obligations imposed on Netflix by Italian Justiça
In addition to individual refunds, the platform must promote immediate adjustments to current subscription prices. The court decision reinforces consumer protection against unilateral modifications without clear justification in digital service contracts.
The case reinforces the application of Italian Código in streaming contracts and can serve as a reference for similar discussions in other markets. Netflix, in turn, maintains the understanding that its contractual practices were in compliance with current legislation.
