Canada records 50% increase in citizenship applications by Americans after new rules
Canadá has seen a significant increase in citizenship applications in recent months, driven largely by requests from Estados Unidos. Dados of Immigration, Refugees and Citizenship Canada (IRCC) reveal an increase of almost 50% in applications for proof of citizenship in January 2026, compared to the same period in the previous year. Essa high coincides with the implementation and clarification of new rules under Bill C-3, which expands the ability for parents to pass on Canadian citizenship to their children.
The changes to the legislation, which came into force in December last year, aim to correct previous court decisions that considered some limitations to citizenship by descent unconstitutional. Os Estados Unidos, remarkably, leads the number of applications, surpassing other nations by a significant margin. The Canadian government’s move goes against the global trend, where many countries have tightened their requirements for obtaining citizenship.
Americanos leads rise in citizenship applications
The month of January 2026 saw 8,900 applications for proof of citizenship received by the Canadian government. Este number represents a notable growth from the 5,940 applications registered in January of the previous year, indicating a growing interest in Canadian citizenship. Deste total, 2,470 applications, almost 28%, originated from Estados Unidos. Esse volume puts North Americans at the forefront, highlighting an intense search for Canadian documentation.
In comparison, the second largest group of applications came from Reino Unido, with 290 applications, followed by México, with 235. Nenhum another country surpassed the 140 application mark in the period analyzed. Muitos countries registered 30 or fewer applications. Entre December 15 last year, when the new rules were initially applied, and January 31, 2026, IRCC processed a total of 12,430 requests for proof of citizenship. The department clarifies that these numbers are not limited to just citizenship by descent, but include other categories, such as individuals born under Canadá requesting a certificate or requesting a replacement document. Aproximadamente 2,500 Americans had their applications for Canadian citizenship approved in January alone.
Legal Mudanças Drive New Descent Rules
The review of Canadian citizenship laws was driven by a significant court ruling. On December 19, 2023, Tribunal Superior of Justiça of Ontário declared unconstitutional crucial portions of Lei of Cidadania related to the first-generation limit for citizenship by descent. Este limit, introduced in 2009, prevented a child born or adopted outside the Canadá from automatically obtaining citizenship if their Canadian parent had also been born or adopted outside the country.
The federal government chose not to appeal the decision, agreeing that the previous legislation created unacceptable outcomes for the children of Canadian citizens born abroad. Bill C-3, by expanding the rules, aims to correct these injustices and ensure that citizenship can be passed down more broadly between generations. The measure represents a recognition of family complexities and citizenship rights, aligning legislation with constitutional principles. The new provisions seek to provide greater clarity and access to citizenship for descendants of Canadians.
Entenda the conditions for citizenship by descent
The new Canadian rules establish specific criteria for granting citizenship by descent, covering various situations of birth and adoption outside the country. It is critical to understand these requirements to determine eligibility. The guidelines aim to simplify the process for those who previously faced impediments due to previous legislation.
- Pessoas born after December 15, 2025, outside of Canadá, in the second generation or later, may be citizens if their Canadian parent was also born or adopted outside the country of a Canadian citizen (i.e., the applicant’s grandfather was Canadian) and that same parent resided at least 1,095 days (three years) in Canadá before birth.
- Pessoas adoptees may apply for Canadian citizenship if they were born and adopted outside of Canadá in the second generation or later, and their Canadian parent resided at least 1,095 days in Canadá prior to adoption.
- Citizenship may have been restored or granted to people who were born outside the Canadá in the second generation or later before December 15, 2025. Isso means that in most cases, the person is automatically a Canadian citizen if they were born before December 15, 2025, outside the Canadá, to a Canadian parent.
- Esta rule also applies to anyone born to someone who became Canadian due to these rule changes. Caso the change automatically makes someone Canadian, but the person does not want citizenship, it is possible to request a renunciation.
Canadian Tendência goes against global movement
Canadá’s decision to relax its citizenship rules contrasts with a global pattern observed in many other countries, which have implemented more stringent requirements. Essa The Canadian government’s distinct stance reflects a particular approach to immigration and citizenship rights. Enquanto nations like Itália, Finlândia and Suécia seek to toughen their laws, Canadá expands the possibilities for descendants.
Last year, Itália passed a law restricting citizenship to descendants of a parent or grandparent born on Italian soil. The previous rule did not have a generational limit, which allowed for broader access. Já to Finlândia, in 2024, increased the length of residence required before applying for citizenship, from five to eight years. The move aims to promote the integration of immigrants, focusing on language skills and long-term residency. Suécia is also considering a similar move to come into force this year, following the trend of many European countries seeking greater control over naturalization processes.
