Consolidação of Leis of Trabalho (CLT) establishes prior notice as a mandatory step in the termination of contracts for an indefinite period without just cause. The measure guarantees predictability for both parties. The mechanism works as an advance notification between the employer and the employee, formalizing the end of the employment relationship. The minimum period required by Brazilian legislation is 30 calendar days. Durante this interval, contractual obligations remain active, requiring compliance with duties and ensuring the maintenance of labor rights.

The main purpose of advance notice is to provide adequate transition time. Para the worker, the period offers the opportunity to seek a new job in the job market before the total interruption of his income. Para the company, the deadline allows for internal organization, the opening of selection processes and the training of a replacement for the role. The application of this rule varies according to the party that initiates the dismissal and the length of service provided by the employee in the same organization.

Modalidades compliance and impact on working hours

Labor legislation divides notice into three main categories, applied according to the company’s needs and the context of the dismissal. The first modality is the worked advance notice. Neste format, the employee continues to carry out their normal activities on the company’s premises or remotely during the stipulated period. The worker maintains the right to receive full salary, in addition to all usual benefits, such as transportation vouchers, meal vouchers and medical assistance, until the last day of the contract.

Durante compliance with the notice worked in the event of dismissal by the company, the CLT ensures that the employee has flexible working hours. The professional has the right to choose between two alternatives to facilitate the search for a new job. The first option consists of reducing your normal working day by two hours a day, without any deduction from your salary. The second alternative allows the employee to work the full day, but terminate their activities seven days before the official end of the 30-day notice. The choice must be formalized when signing the termination form.

The second modality is compensated notice, used when the employer decides to immediately dismiss the employee. The company exempts the professional from working hours, but assumes the obligation to pay the amount corresponding to that month’s salary upon termination. Esta practice frequently occurs when the organization seeks a quick restructuring, deals with confidential information or prefers to avoid the climate of demotivation in the corporate environment. The compensated period also includes the length of service for the purposes of calculating vacation and thirteenth salary.

The third category involves prior notice proportional to length of service, established by Lei 12.506/11. The rule exclusively benefits workers fired without just cause by the company. The legislation determines the addition of three days of notice for each full year of work provided to the same employer. The maximum limit established is 90 days, reached only by professionals with 20 years or more of registration with the same company. An employee with five full years at the company, for example, completes the basic 30 days plus 15 proportional days, totaling 45 days of notice.

Diferenças between resignation and dismissal by the company

The obligation and rules of prior notice change depending on who takes the initiative to end the contract. Quando the worker decides to resign, he has a legal duty to give the company 30 days’ notice. The objective is to prevent the employer from being harmed by the professional’s sudden departure. In the Neste scenario, the employee is not entitled to a reduction of two hours per day or exemption from the last seven days, and must complete the entire shift until the end of the period.

Caso the employee resigns and decides not to comply with the notice period, the company has the right to deduct the amount corresponding to 30 days’ salary from the severance pay. The discount occurs because the immediate departure constitutes a breach of the warning. The only exception occurs if the employer decides, out of liberality, to exempt the employee from compliance, formalizing the exemption in the termination document. Algumas collective agreements also provide for waiving the notice if the worker proves that they have obtained a new job, but the rule requires union analysis.

In the opposite situation, when the company dismisses the employee without just cause, the power to choose the type of notice belongs to the employer. The organization defines whether the professional will complete the period working or whether he or she will receive the corresponding compensation. If the company requires compliance with work and the employee is absent without medical justification, the days of absence are directly discounted in the final calculation of termination, reducing the amount to be received by the employee.

Prazos legal for financial settlement and penalties

The format of the notice directly determines the legal deadline for payment of severance pay. Reforma Trabalhista unified most of the payment rules, establishing a strict limit for companies to pay their obligations to terminated workers. Failure to comply with the dates generates labor liabilities and financial fines for employers.

According to current legislation, payment of all severance pay must occur within 10 calendar days, counting from the end of the employment contract. The 10-day rule applies to both paid notice and worked notice. Durante the financial settlement, the human resources department must calculate and deposit the following worker rights:

  • Saldo salary corresponding to the days actually worked in the month of termination.
  • Férias due and proportional, plus the mandatory constitutional third.
  • Décimo third salary proportional to the months worked in the current year.
  • Multa severance pay of 40% on the total balance of Fundo of Garantia of Tempo of Serviço (FGTS), in cases of unfair dismissal.
  • Valor of the prior notice itself, when this is in the indemnified form.

Delay in paying severance pay results in the imposition of the fine provided for in article 477 of the CLT. The penalty obliges the company to pay the worker the equivalent of one month’s nominal salary, in addition to the corrections due. Ministério supervision of Trabalho and regional courts act strictly in charging these deadlines, requiring that deposit slips be issued within the limit of 10 calendar days.

Exceções to the rule and application in the teleworking regime

The legislation establishes specific scenarios where prior notice loses its obligation. The main exception occurs in dismissal for just cause. Quando the worker commits a serious misconduct, provided for in article 482 of the CLT, the employer acquires the right to terminate the contract immediately. Neste case, the employee loses the right to prior notice, withdrawal of FGTS, 40% fine and proportional thirteenth, receiving only the balance of salary and accrued vacation.

Fixed-term employment contracts, such as experience contracts, also have different rules. Como both parties already know the exact end date of the relationship from the moment of contracting, there is no need for prior notice. The contract naturally ends on the stipulated date. However, if there is a clause ensuring a reciprocal right to early termination, breaking the contract before the deadline requires the application of normal notice rules.

With the expansion of the teleworking regime, known as home office, the prior notice rules maintain the same legal validity as in-person models. The employee who is fired or resigns remotely fulfills the notice by working from home, respecting the working day, login times and delivery of demands. The company remains obliged to provide equipment and technical support until the last day of the contract.

Prior notice management requires attention to operational and documentary details. The companies’ personnel department must issue notification letters in two copies, collect dated signatures and clearly specify the chosen modality. Correctly recording information in the eSocial system guarantees compliance with government requirements and allows workers to access unemployment insurance and withdraw FGTS without bureaucratic obstacles after the end of the transition period.
