Court condemns MC Ryan SP for copyright infringement on 34 songs and imposes fine
The artist MC Ryan SP, known for being one of the most listened to names in Brazil, according to data from Spotify, was convicted of copyright infringement. The court decision determined that the funk singer did not credit Lucas Vieira Jozimba, identified as the author of 34 compositions that are part of the singer’s repertoire.
Lucas, who uses the stage name Luska, presented the court with conversations in which, according to him, he sent the lyrics to the funk artist. The promise was that the profits would be divided and the credits duly included, which, in practice, did not happen.
Among the tracks mentioned in the process are “Marcha”, “Amante da Minha Conta” and “Cracolândia”. The latter is one of MC Ryan SP’s biggest hits, accumulating more than 200 million views on platforms such as YouTube.

During the process, MC Ryan SP and the production company GR6 challenged the evidence presented by the author. They argued that the songs in question were not registered with the Brazilian Union of Composers (UBC).
Both the singer and the company also argued that the works mentioned were authored by MC Ryan SP himself or by another artist, MC BKA.

In his sentence, judge Rodrigo Garcia Martinez, from the 12th Civil Court of Santos (SP), highlighted a crucial point in copyright legislation. The judge stated that copyright protection “categorically establishes that copyright protection is independent of registration.”
With this legal prerogative, the evidence presented by Luska, such as the app conversation records, were considered valid to prove and ensure his rights as a composer.
Furthermore, the court decision also pointed out that only 11 of the 34 songs in question were registered with UBC in the name of Ryan SP. However, the registration of phonograms or works is the responsibility of the phonographic producer, which in this case would be GR6 itself.
The court order recognized Luska as the author of the songs and established that MC Ryan SP and GR6 must include the composer’s name on all digital platforms and Ecad. The deadline for this regularization is 30 days, under penalty of a daily fine of R$1,000.
The court also ordered the defendants to pay all profits arising from the transfer of rights and royalties from the 34 songs, to be calculated from the date of release of each one. The exact amount for this compensation is still under analysis.
Finally, those involved were ordered to pay R$20,000 in moral damages, due to the omission of Luska’s name as composer of the works.
