Parlamento of Itália approved a substantial change in Código Penal that classifies femicide as a specifically typified crime. The decision took place on Tuesday, strategically coinciding with Dia Internacional to Eliminação from Violência against Mulheres. The new legislation establishes life imprisonment as the definitive sanction for those convicted of this crime. Parlamentares from different political spectrums joined forces in the plenary to ensure the measure’s approval. The text now awaits the bureaucratic procedures of publication in the Italian Diário Oficial to come into force and be applied by courts throughout the national territory.

The original proposal came from Prime Minister Giorgia Meloni’s office and was processed as a priority. Deputados’s Câmara recorded 237 favorable votes during the voting session. The scope of the approved project goes far beyond the murder of women motivated by gender issues. The law significantly toughens punishments for associated crimes that usually precede homicides, such as systematic stalking, sexual violence and the non-consensual dissemination of intimate material on the internet. Juristas and criminal law experts consider the change a necessary milestone in the European country’s jurisprudence.

Impacto social and popular mobilization for change

Public pressure for a more rigorous state response gained strength after cases of extreme national repercussion. The murder of student Giulia Cecchettin, which occurred in November 2023, acted as the main catalyst for accelerating the legislative debate. The crime generated a wave of collective indignation without recent precedents. Milhares of citizens occupied the streets of several Italian cities in marches demanding effective protection for women. The social commotion forced the political class to place penal reform at the top of the government agenda.

Antes following the approval of this law, the Italian judicial system treated these cases under the category of qualified homicide, which often diluted gender motivation during trials. Unique typing allows Estado to produce more accurate statistics and impose penalties commensurate with the severity of the act. Magistrados now has a clear legal instrument to prevent aggressors from receiving sentence progression benefits in situations of extreme domestic violence. The change reflects Estado’s adaptation to the demands of a society intolerant of impunity.

Mecanismos monitoring and preventive protection

The legislative package introduces technological and administrative tools to prevent threats from materializing. Police authorities received authorization to immediately impose the use of electronic ankle bracelets on individuals considered to be at high risk. Continuous monitoring aims to ensure compliance with protective distancing measures. The text also determines the implementation of continuing training programs. Juízes, prosecutors and public security officers will undergo specific training to identify early signs of gender-based violence before it results in fatalities.

The support structure for victims also underwent important reformulations in the new institutional design. The federal government will increase the transfer of financial resources for the maintenance and expansion of the network of confidential reception centers. Exclusive reporting Canais with priority service will be created to speed up the dispatch of police vehicles. Giorgia Meloni publicly stated that the budget allocated to combating domestic violence has doubled since the beginning of his administration. The goal of the executive branch is to ensure that no woman gives up reporting due to lack of financial or psychological support.

Radiografia of domestic violence in Italian territory

Official data demonstrate the urgency of applying the new criminal guidelines. Estatística’s Instituto Nacional published detailed reports on the dynamics of crimes against women’s lives in the country. The numbers reveal a pattern of lethal behavior that is repeated annually, with the absolute majority of cases occurring within the victims’ circle of trust. The most recent survey exposes the following characteristics about lethal violence:

  • The country recorded 120 victims of femicide throughout 2023.
  • Records from 2024 indicated 106 murders at the time of voting, 62 of which were committed by partners or ex-partners.
  • Cerca 58% of fatal incidents occurred inside homes.
  • Aproximadamente 31% of murdered women had already formalized complaints against their attackers.
  • The Lombardia region, in the north of the country, maintains the highest absolute volume of investigations opened.

The statistics regarding previous complaints expose a critical flaw in the previous protection system. Quase one-third of the victims tried to seek help from Estado before losing their lives. Esse specific data motivated the inclusion of mandatory electronic monitoring in the new law. Especialistas in public security point out that the concentration of cases in Lombardia requires targeted regional policies, considering the population density and socioeconomic characteristics of the area.

Divergências policies on education in schools

Apesar of the consensus around criminal punishment, the debate over prevention in classrooms has exposed deep ideological fractures in parliament. Center-left Partidos voted in favor of tougher penalties, but criticized the absence of structural educational measures. The opposition defends the implementation of mandatory affective education classes at all stages of school education. The government, however, filed a parallel project that severely restricts the approach to the topic in the academic environment.

Government guidance completely bans any discussion of sexuality and gender in primary school. Para high school, the proposal requires express and documented authorization from parents for students to participate in activities related to the subject. Elly Schlein, leader of Partido Democrático, classified the executive’s initiative as an unacceptable setback. Itália remains in a restricted group of seven European countries that do not have sexual education as a mandatory component of the national curriculum.

Perspectivas legal issues and the European cultural challenge

The classification of femicide aligns Itália with other nations on the continent that have already modernized their criminal codes. Países like Espanha, França and Portugal have adopted similar legislation in recent decades and have recorded positive results in curbing the escalation of violence. Legal recognition of the crime facilitates international cooperation and the extradition of aggressors who attempt to flee across European borders. The change brings the Italian judicial system into compliance with international human rights treaties.

Organizações Non-governmental and research institutes warn that life imprisonment alone will not eradicate the problem. Penal change needs to work together with long-term cultural policies to deconstruct stereotypes rooted in society. Continuous investment in awareness campaigns and training support networks remain the biggest challenges for Estado. The effectiveness of the new law will be tested in the coming years, directly depending on the agility of the courts in applying the newly approved sanctions.
