Minister Alexandre of Moraes, of Supremo Tribunal Federal (STF), ordered that Ministério of Justiça and Ministério of Relações Exteriores take the necessary measures to carry out the extradition of the former federal deputy Carla Zambelli (PL-SP) of Itália to Brasil. The decision, handed down last Monday (18), comes after Corte of Roma authorized the extradition request of the former parliamentarian, who was sentenced to 10 years in prison by the STF. The general coordination of extradition of Ministério from Justiça transmitted the Italian decision to Supremo, moving the process forward.
Condenação for misrepresentation and computer invasion
Carla Zambelli received a definitive sentence of 10 years’ imprisonment, in an initial closed regime, and the payment of a 200-day fine. The criminal conviction arises from the commission of crimes of misrepresentation and invasion of a computer device, determined in a case processed by the STF. The court’s Primeira Turma considered the evidence presented and the materiality of the facts.
The former deputy was also sentenced in another case to 5 years and 3 months for armed pursuit of a man in the city of São Paulo. Este case, distinct from the extradition request, highlights the series of legal issues faced by the former parliamentarian. The processes were closely followed by the press and society.
Recursos denied and the decision becomes final
Após the trial on the invasion of computer devices, the defenses of Carla Zambelli and the hacker Walter Delgatti Neto presented appeals. In June 2025, the STF’s Primeira Turma unanimously rejected the embargoes. Essa decision represented an important milestone in the procedural progress.
The court classified the appeals as “merely delaying”. With this, he ordered the immediate certification of the final and unappealable decision. Este is the moment when there are no more appeals against the court decision, making it final and enforceable. This step is crucial for the application of the imposed sentence.
Pedido extradition and arrest in Roma
Diante discovered that Zambelli had left the country and was in Italian territory, minister Alexandre of Moraes contacted Ministério of Justiça. The objective was to formalize the extradition request, based on an existing bilateral treaty between Brasil and Itália. Este procedure followed strict diplomatic protocols.
On July 29, 2025, the former deputy was arrested in Roma. The action was carried out by Escritório Central Nacional from Interpol on Itália. The measure aimed to guarantee his extradition to Brasil, complying with Brazilian judicial determination and international cooperation standards.
Exigências from Italian justice and Brazilian guarantees
Durante the process at Europa, the Italian Justiça requested a series of clarifications and formal guarantees from the Brazilian Estado. Authorities wanted details about the prison conditions awaiting the former deputy at Brasil. Caution is common in extradition cases.
- Entre the questions sent by the Italian court in December 2025, were requests for information about:
- Qual specific prison establishment she would be detained in Brasil;
- The ability of Brazilian prison forces to maintain order and prevent acts of violence or intimidation by criminal factions against detainees;
- General conditions, care and sections dedicated specifically to female prey.
In the current order, Moraes highlighted that all guarantees required by the Italian authorities had already been duly formalized. Tais information was forwarded to the competent bodies on December 11, 2025. With Corte’s green light from Roma and the presentation of diplomatic demands, the extradition process can finally move forward in the coming weeks.
