Federal judge grants Joe Biden three-week delay blocking Hur investigation audio release

A federal court has granted former President Joe Biden a temporary reprieve in his legal battle to prevent the public release of audio recordings and transcripts connected to Special Counsel Robert Hur’s classified documents probe. U.S. District Judge Dabney Friedrich issued an injunction pending appeal that gives Biden three additional weeks while the D.C. Circuit Court of Appeals examines his challenge. The recordings in question stem from conversations between Biden and Mark Zwonitzer, who served as the ghostwriter for Biden’s 2017 memoir “Promise Me, Dad.”

The ruling came Friday, just hours after the same judge denied Biden’s request for a preliminary injunction that would have blocked the materials indefinitely. The temporary order prevents the Justice Department from disclosing the recordings and transcripts while appellate judges review the legal arguments. Biden’s legal team immediately sought emergency relief after the initial denial, arguing that releasing the materials would effectively end the case before higher courts could weigh in on the constitutional questions at stake.

Recordings differ from previously released Hur interview audio

The audio recordings at the center of this dispute are separate from materials already made public. The Justice Department previously released recordings of Biden’s direct interviews with Special Counsel Hur. The current legal fight involves different recordings—specifically, conversations between Biden and Zwonitzer that occurred during the writing process of his memoir. Hur’s 2024 report referenced these Zwonitzer conversations extensively, using them as evidence in his decision not to prosecute Biden for mishandling classified documents.

The special counsel’s report described some of Biden’s exchanges with his ghostwriter as “painfully slow” and noted instances where Biden appeared to struggle recalling events and relaying information clearly. These observations sparked intense scrutiny of the then-president’s cognitive abilities during an election year. The characterizations in Hur’s report became a political flashpoint, making the underlying audio recordings highly sought after by Biden’s critics and transparency advocates alike.

Heritage Foundation pushes for transparency after two-year effort

The Heritage Foundation and its Oversight Project director Mike Howell have pursued the recordings and transcripts for more than two years through Freedom of Information Act requests. Heritage officials argue the public holds a strong interest in reviewing materials referenced throughout Hur’s report, particularly because the special counsel relied on these recordings when explaining his decision not to bring criminal charges. The conservative organization contends that transparency demands access to evidence that shaped such a consequential prosecutorial decision.

The Justice Department initially withheld the recordings under several FOIA exemptions designed to protect sensitive materials. However, earlier this year the department reversed its position, determining that the records could be released with appropriate redactions. Officials concluded that significant public interest existed in understanding the evidence Hur considered during his investigation. This policy shift prompted Biden to file suit in May, launching the current legal battle.

Biden invokes Privacy Act protections to block disclosure

Biden’s lawsuit claims the audiotapes contain private conversations that should remain shielded from public release. His legal team argues that disclosure would violate the Privacy Act and constitute arbitrary agency action under the Administrative Procedure Act. The former president’s attorneys maintain that once the recordings become public, any privacy protections would be permanently lost, making the appeal essentially moot regardless of its outcome.

  • Biden’s emergency filing stressed that the FOIA litigation has already been pending for more than two years
  • His attorneys argued there is no urgent public need requiring immediate disclosure of decade-old conversations
  • The legal team emphasized that Biden is now a private citizen who neither holds nor seeks public office
  • They contend the recordings involve personal reflections shared during the memoir writing process

Amy Jeffress, a partner at Washington-based law firm Hecker Fink and former Justice Department national security official, is leading Biden’s legal effort. Jeffress signed the recent emergency filing seeking to prevent disclosure while the appeal proceeds. She has served as the primary attorney advancing Biden’s challenge throughout the case.

Controversy surrounds Biden attorney’s marriage to federal judge

Jeffress has drawn attention because she is married to U.S. District Judge Christopher Cooper, an Obama appointee who recently ruled against the Trump administration in a high-profile dispute involving the Kennedy Center. Cooper’s ruling prompted criticism from Trump allies and conservative commentators who pointed to the judge’s family connection to Biden’s attorney, suggesting a potential conflict of interest may exist in Cooper’s judicial work. The connection has fueled broader debates about judicial impartiality in politically charged cases.

Judge Friedrich, who granted the temporary injunction, was appointed by former President Donald Trump. Her decision to allow a three-week delay while denying longer-term protection reflects the complex legal balancing act courts face in FOIA disputes involving former government officials. The D.C. Circuit now has three weeks to determine whether Biden’s privacy claims outweigh public interest in accessing materials that informed a major prosecutorial decision involving classified documents.

Case tests boundaries between privacy rights and public accountability

The legal battle raises fundamental questions about where privacy rights end and public accountability begins for former presidents. Biden’s team argues that private citizens, even those who previously held the highest office, retain certain protections against disclosure of personal conversations. The Heritage Foundation counters that materials used as evidence in a special counsel investigation—especially one that resulted in no charges despite acknowledged mishandling of classified information—must be accessible to ensure government transparency.

The outcome could establish precedent for future disputes involving former officials and special counsel investigations. If the appeals court sides with Biden, it could strengthen privacy protections for conversations between public figures and advisors or collaborators. A ruling favoring disclosure could make it harder for former officials to shield materials referenced in official investigations, even after leaving office. The three-week injunction keeps the status quo in place while appellate judges examine these competing interests.
