Utah judge rules that prosecutor in Tyler Robinson case broke rules by commenting on guilt in Charlie Kirk’s murder
A Utah state prosecutor was held responsible last Friday for violating judicial rules. The court decision found that he made statements to a media station about the alleged guilt of Tyler Robinson, a defendant in the case of the murder of conservative activist Charlie Kirk.
District Court Magistrate Tony Graf imposed measures aimed at preventing remarks made by Utah County prosecutor Christopher Ballard from affecting the impartiality of potential jurors if the case goes to a grand jury.
However, Judge Graf declined the defense team’s request to punish the prosecution for Ballard’s statements, which would have allowed prosecutors to continue seeking the death penalty for Robinson despite the prosecutor’s conduct.
Ballard had spoken to journalists about rumors that analysis of a projectile fragment found in Kirk’s body could exonerate Robinson. The results of that examination were considered “inconclusive”, although they indicated that the bullet was fired from a rifle where Robinson’s DNA was allegedly detected.

Graf’s ruling confirmed that Ballard committed “civil contempt” of rules regulating communication with the media. The prosecutor had told TMZ that, regardless of the test’s conclusions, the prosecution already had enough evidence to establish Robinson’s guilt.
The prosecution is currently seeking the death penalty for Robinson if he is convicted of Kirk’s murder, which occurred on September 10, 2025.
At the time of the incident, Robinson, who is 23, was studying to become an electrician. He is credited with firing a lone shot from a roof, which hit Kirk while he was participating in a debate with students at Utah Valley University, located in Orem.
Charlie Kirk was known for his ability to engage young voters, contributing to President Donald Trump’s victory in the 2024 election. His death on stage in front of a crowd underscored the alarming escalation of political violence in the United States.
