Comissão on Mortos and Desaparecidos Políticos (CEMDP) concluded that former president Juscelino Kubitschek died in 1976 as a result of action by the military dictatorship. Rapporteur Maria Cecília Adão’s report will soon be voted on by the councilors. The expectation is for majority approval.

The document has more than 5 thousand pages. Ele reviews the case almost 50 years after the fact that occurred on August 22, 1976 at Via Dutra. At the time, the Opala driven by Geraldo Ribeiro, driver and friend of JK, lost control, crossed the median and collided with a trailer in the opposite lane. Ribeiro also died.

Relatório rejects official version of accident

Investigations at the time pointed to a collision with an Viação Cometa bus while overtaking. Essa thesis was maintained by a committee of Câmara in 2001 and by Comissão Nacional of Verdade in 2014. The new CEMDP opinion disputes this conclusion.

Perícia technique commissioned by Ministério Público Federal between 2013 and 2019 overturned previous reports. Engineer Sergio Ejzenberg analyzed Instituto’s studies from Criminalística Carlos Éboli. Ele concluded that there was no impact with the bus before Opala lost control.

Prosecutor Paulo Sérgio Ferreira Filho highlighted flaws in the initial investigations. Não Complete toxicological tests were carried out on Geraldo Ribeiro’s body. Processos against the bus driver ended in acquittal.

  • The report compiles work from state truth commissions of São Paulo, Minas Gerais and the municipality of São Paulo
  • Ele cites MPF civil inquiry as main reference
  • The text applies the principle “in dubio pro victima” to attribute responsibility to Estado
  • The document mentions the context of JK’s opposition to the dictatorship
  • The rapporteur avoided commenting on the content while the panel analyzes the opinion

Contexto politician of death

Juscelino Kubitschek was impeached in 1964 and had political rights suspended for ten years. In 1976, he was part of Frente Ampla, a movement opposing the regime. The report recalls Operação Condor, Cone Sul’s articulation of dictatorships. A letter from Chilean Manuel Contreras to João Figueiredo cited JK as a threat.

The case follows a pattern seen with the stylist Zuzu Angel. Her death in a car accident was later recognized as an attack. In the case of JK, rectification of the death certificate may record death due to political persecution. Não provides compensation to the family because the legal deadlines have expired.

CEMDP, created in 1995 under the Fernando Henrique Cardoso government, recognizes victims from 1961 to 1988. The body has support from Ministério of Direitos Humanos. Sete advisors participate in the vote. The opinion must obtain at least five favorable votes.

Votação postponed for deeper analysis

Reunião scheduled for April in São Paulo has been postponed. Conselheiros asked for extra time to study the voluminous material. Rapporteur Maria Cecília Adão is a historian. Representantes of Ministério Público Federal and Defesa demonstrated initial resistance.

Defesa representative, Rafaelo Abritta, warned of legal risks of decisions without a solid basis. Ele is expected to leave the board soon. The successor has not yet taken over.

The incident occurred at kilometer 165 of Via Dutra, at Resende, at Rio of Janeiro. JK was traveling from São Paulo to Rio. The accident has since mobilized debates about the real circumstances.

What changes with possible approval

Official recognition reinforces the role of CEMDP in historical memory. Ele does not open new criminal investigations. The focus remains on institutional clarification.

JK was president between 1956 and 1961. Seu government marked infrastructure works and the motto “50 years in 5”. His death continues to generate divergent interpretations. The commission’s report represents a new chapter in this story.
