Kemar Downer, 40, who works for Sayle’s Seafood, appeared in Nantucket District Court on Wednesday morning to face two counts of assault and battery with a dangerous weapon causing serious bodily injury. His attorney asserts that video evidence clearly demonstrates the altercation that unfolded Tuesday morning in the island’s busy downtown area was an act of self-preservation.

Defense attorney Rob Moriarty told reporters that the surveillance recording supports his client’s account entirely. The footage allegedly shows a larger man, identified as a Reis Trucking employee, approaching Downer from behind and launching a sudden assault. According to Moriarty, this constitutes “complete and total self-defense” under Massachusetts law.

The defense lawyer provided detailed descriptions of what the surveillance video allegedly reveals. Moriarty stated that the alleged victim approached Downer without warning and struck him multiple times in the back of the head. The surprise attack reportedly knocked the seafood worker forward into an object, though the attorney could not specify exactly what it was from viewing the footage. The assault continued with multiple kicks while Downer was in a vulnerable position, according to the defense account.

Moriarty indicated that the confrontation stemmed from a dispute involving a woman, as reported by The Inquirer and Mirror. The attorney emphasized the size disparity between the two men, noting that the alleged victim was considerably larger than his client. Only after sustaining repeated blows and kicks did Downer retrieve a pocketknife from his waistband, the defense claims.

Incident unfolds in heart of tourist district

The violent encounter erupted at approximately 10:23 a.m. Tuesday on South Beach Street, a central downtown corridor situated between Broad Street and Oak Street. This location sits just steps from the Steamship Authority ferry terminal, where tourists regularly arrive carrying beach gear and luggage before dispersing throughout Nantucket’s historic cobblestoned neighborhoods. Police officers responded rapidly to emergency calls reporting a stabbing in progress.

According to police reports cited by local media, Downer was making a juice delivery to The Juice Bar, a popular ice cream establishment on the island, when the confrontation began. The defendant reportedly told investigators he did not know his attacker, though both men originated from the same parish in Jamaica. After being punched in the head from behind, Downer said he turned around, was kicked, and then pulled out a pocketknife, swinging it toward the other man two or three times.

Nantucket police Sergeant Travis Ray located and arrested Downer nearby on South Beach Street, where he was found sitting in a chair on the sidewalk.

He must stay away from the alleged victim and have no contact with him whatsoever.
