Modifications to Unity’s terms of service raise doubts about the use of artificial intelligence in game development

Unity Technologies updated the terms of use of its popular game engine, Unity, on June 30th, according to local time. The new guidelines encompass a measure to limit the operation of artificial intelligence tools developed by third parties, including AI agents and MCP servers. However, the company clarified, in a forum on Reddit, that this change does not prevent the use of such tools on local platforms, but rather seeks to avoid reverse engineering and improper collection of data from the platform.

Developers’ main attention is on reviewing Article 17, Paragraph 2, called “Usage Restrictions”, of the Unity Terms of Service. The recent conditions now require prior authorization to use Unity resources or information generated by the platform in activities such as training, validating or improving machine learning or artificial intelligence models. Additionally, access and operation through AI agents, large language models, MCP clients and servers will only be permitted through structures operated or previously approved by Unity itself.

The company emphasizes that developers assume full responsibility for the use of these artificial intelligence solutions, and failure to comply with these rules may result in the suspension of access to the platform. Other changes to regulations also impose barriers to the practice of automated data scraping and the use of bots targeting the company’s products and services.

Expanding Unity’s AI tools

In recent years, the company has invested considerably in the development of tools to support the creation of games that use artificial intelligence. With the release of Unity 6, the official “Unity AI” suite of tools was introduced, with an open testing period beginning in May of this year. The “Unity AI” package offers features such as the “Unity AI Assistant” AI agent, “Generators” to create graphical elements from textual descriptions, the “AI Gateway” to integrate external AI agents, and the “Unity MCP Server” to connect external tools directly to the Unity editor.

In this scenario, the new terms of service rules can be seen as an effort to centralize access to the platform through AI tools under the supervision of the official “AI Gateway” and “Unity MCP Server”. This change, which may seem abrupt to some, is generating discussion and some concern among developers who already rely on MCP servers and other third-party AI tools.

Unity’s position to clarify the new conditions

Faced with the repercussions, Unity Technologies used the international forum Reddit to detail the revisions to its terms of service. The company explained that the use of tools in local environments will not be restricted and that the limitations only apply to access to the Unity cloud platform, online services, the asset store and the online API. It was reinforced that the modifications aim to prevent reverse engineering or data extraction from Unity products. However, the crucial point that generated requests for clarification is that these considerations are not yet clearly expressed in the published terms of service, creating a gap between communication and the legal text.

At the same time, the incorporation of artificial intelligence resources is also advancing in Unreal Engine. Version 5.8 of the game engine introduced “Unreal MCP” as an experimental feature, enabling users to manage their projects through an AI agent. With the increasing pervasiveness of AI in game engines, each company’s future policies will continue to be under the watchful eye of the developer community.
