Court orders Corinthians to compensate Daniel Marcos with R$3 million
Justiça of Trabalho ordered Corinthians to pay more than R$3 million to former full-back Daniel Marcos for the loss of his sporting career. The decision, released this Thursday, holds the São Paulo club responsible for the consequences of an injury suffered at the base that prevented the athlete from continuing in professional football. Marcos announced his retirement in January 2026, at the age of 23, after four years of trying to recover. The total value of the sentence, including legal fees and corrections at the Selic rate, exceeds R$3.5 million. Corinthians confirmed that it intends to appeal the first instance sentence.
Origem of the injury and first surgeries
The problem began in December 2020, when Daniel Marcos tore ligaments in his right knee during a game between Corinthians and Grêmio for Campeonato Brasileiro Sub-20. Logo After the injury, the club offered the full-back a professional contract, guaranteeing financial stability with salaries of R$17,000 per month until the end of 2024. Apesar from the initial support, the player faced a series of complications that required multiple surgical interventions over four years.
The first surgery was performed weeks after the accident. Contudo, attempts to return to the field revealed the severity of the clinical problem. Durante During his loan periods at other clubs, the full-back faced new setbacks that worsened both his physical and psychological condition. The defense described the rehabilitation process as extremely challenging, with pain that limited basic movements whenever he tried to gain a competitive pace.
Trajetória of loans and new injuries
- Empréstimo to Cianorte in 2022 ended with a new injury to the same knee.
- Retorno to Parque São Jorge to perform the second reconstructive surgery.
- Repasse to Ferroviário in May 2023 with returns in just 30 days.
- Avaliação from the Ceará medical department found it impossible to play competitively.
- Terceira surgery performed in June 2023 under Corinthian supervision.
Cada attempt to return resulted in frustration. Ferroviário returned the winger to Corinthians after just one month, stating that the physical conditions did not allow its use. The sequence of failures showed that full recovery of the knee was not viable, despite the club’s medical investments.
Rescisão contractual and last attempt
Corinthians terminated Daniel Marcos’s contract in March 2024, paying R$131,000 in severance pay. Livre on the market, the side tried one last opportunity at Resende, from Rio to Janeiro. Novamente, the physical disability persisted and prevented his competitive performance. Sem’s prospects improved and after conclusive medical evaluations, the official retirement announcement took place in early 2026.
Argumentação legal and sentencing
The current condemnation focuses on concepts of loss of profit and loss of a chance, applied when a professional loses the ability to exercise their craft. Lawyer Filipe Rino, representing Daniel, initially sought R$5 million in compensation. The sentence set the principal amount at R$3 million, in addition to R$149,000 allocated to succumbing fees. The responsible magistrate understood that the causal link between the work accident at Sub-20 and the sports disability was established.
Corinthians’s legal department bases its appeal on the thesis that all necessary medical procedures were offered to the athlete. The club maintains that it provided assistance during successive recoveries and that injuries are part of the risk inherent to the playing profession. Para the board, civil liability requires proof of negligence that it denies having occurred. Contudo, the court considered that the athlete was no longer able to perform at high performance, consolidating the conviction. With the monetary correction linked to official indices, the club’s liabilities could grow while the case is being processed in higher courts.
