Federal Deputy Lindbergh Farias (PT-RJ) has formally submitted a representation to Brazil’s Superior Electoral Court (TSE), alleging premature election campaigning by Senator Flávio Bolsonaro (PL-RJ).

The complaint centers on statements made by Bolsonaro during a right-wing rally held in São Paulo on a recent Sunday. Farias contends that the senator’s remarks contained “unequivocal electoral content,” transforming the public gathering into a platform for soliciting support.

Flávio Bolsonaro is widely considered a pre-candidate for the presidency in the upcoming 2026 elections, making any perceived electoral activity outside the legally stipulated period subject to scrutiny.

Electoral challenge sparks debate

Farias’s filing details specific instances from the Avenida Paulista demonstration where, according to the deputy, Bolsonaro crossed the line into prohibited early propaganda. The action seeks to ensure fairness and adherence to electoral timelines.

The core of the accusation is that Bolsonaro leveraged the event to advance his political aspirations before the official campaign period begins, potentially creating an unfair advantage over other prospective candidates.

Bolsonaro’s controversial Planalto remarks

A key piece of evidence cited in the document is a particular statement by Flávio Bolsonaro regarding his father, former President Jair Bolsonaro. During the rally, the senator recounted a conversation in which he expressed confidence about a future return to the presidential palace.

“I said: ‘Father, in January 2027, you will personally ascend that Planalto ramp alongside the Brazilian people’,” Flávio Bolsonaro declared at the event. This assertion is viewed by Lindbergh as a direct “enunciation with immediate political-electoral meaning.”

Such declarations, particularly when made at a public political event, are often closely scrutinized by electoral authorities to determine if they constitute an implicit request for votes or a clear promotion of future candidacies.

Supreme Court criticisms draw scrutiny

Beyond remarks about the presidency, other statements questioned by Lindbergh Farias focused on the Supreme Federal Court (STF). Flávio Bolsonaro advocated for the impeachment of ministers who he claimed might disregard the law, directly targeting the judiciary.

He further noted the current lack of a right-wing majority in the Senate—the body responsible for reviewing requests to remove Supreme Court justices—and suggested upcoming elections offer an opportunity. Bolsonaro affirmed that “the Brazilian people will have the opportunity this year to choose candidates who commit to the rescue of our democracy.” The complaint argues that “the represented’s speech carries an additional component of gravity: the instrumentalization of the electoral process as a mechanism of pressure on constitutional jurisdiction, through attacks on the Supreme Federal Court and the promise of using political-electoral power to retaliate against ministers.” This aspect of the complaint highlights concerns about undermining institutional stability through electoral discourse.

Legal repercussions and enforcement

Lindbergh Farias’s representation calls for a thorough investigation into Flávio Bolsonaro’s conduct, requesting access to full audio-visual records of the event. Should the TSE recognize the practice of early electoral campaigning, it could impose penalties as stipulated by Brazil’s Election Law.

The potential fine ranges from R$ 5,000 to R$ 25,000, or an amount equivalent to the estimated cost of the propaganda, whichever is higher. The final value could be determined based on “the concrete gravity, the scope of the act, and the need to protect equal opportunities in the electoral process,” according to the filing.

Broader political landscape in 2025

The document also requests that the Electoral Public Prosecutor’s Office and the TSE take “complementary measures” deemed appropriate to prevent future repetitions and safeguard the integrity of the upcoming election. Electoral propaganda is legally permitted only after August 15 of the election year, a rule that the TSE regularly reviews and reinforces.

Rules regarding electoral propaganda for the 2026 election cycle are typically discussed and finalized by the TSE in administrative sessions throughout the preceding year. These guidelines aim to establish clear boundaries for pre-campaign activities.

The recent right-wing rallies, occurring in over 20 cities, primarily targeted the administration of President Luiz Inácio Lula da Silva (PT) and the decisions of STF ministers. These demonstrations marked some of the initial significant opposition movements following Jair Bolsonaro’s designation of his son, Flávio, as a potential presidential contender.

Such events are closely watched by political rivals and electoral bodies alike, setting the tone for the long pre-election period.

Call for electoral integrity

The deputy’s action underscores the ongoing efforts to enforce Brazil’s strict electoral laws, ensuring that all political actors operate within established legal frameworks. Maintaining electoral integrity is paramount for a fair democratic process, especially as the 2026 election cycle begins to take shape.
