Purdue Pharma was ordered by Justiça of Nova Jersey to pay almost US$7.4 billion (approximately R$36 billion) for its responsibility in the serious opioid crisis affecting Estados Unidos. The ruling marks one of the largest settlements against a pharmaceutical company in litigation related to addictive drugs in the country. Conforme the bankruptcy plan approved, the company will be dissolved on May 1st and will use its assets to pay off the compensation established by the court.

The investigation revealed that the pharmaceutical company deceived federal regulators and paid bribes to doctors to boost sales of the painkiller OxyContin, a drug with a high potential for chemical dependency. The fraud schemes operated for years, fueling an epidemic of addiction and overdose that killed tens of thousands of Americans.

Estratégia of regulatory fraud and deception

Purdue Pharma acted systematically to circumvent the federal government’s inspection mechanisms. In 2020, the company had already admitted two serious crimes: first, it deliberately prevented actions by Drug Enforcement Administration (DEA) by falsely presenting that it had maintained an effective program to prevent the diversion of drugs into the illegal market. Segundo, reported misleading information to the agency with the specific aim of increasing authorized quotas for manufacturing OxyContin.

Esses illicit behaviors were not one-off errors. Constituíram a coordinated corporate strategy to maximize profits at the expense of public health. Documentos from the investigation shows internal communications that evidence conscious knowledge of the risks and the deliberate response to conceal them. The company knew it was fueling a crisis but chose the path of profit.

Doctors were given financial incentives to prescribe OxyContin in increasing volumes. Alguns were direct: money for consultancy, speaking engagements and event sponsorship. Outros, more veiled: provision of free samples and promises of commercial loyalty. Assim, inappropriate prescriptions have proliferated in doctors’ offices, leading patients to develop dependence after legitimate pain treatments.

Multas criminal and settlement limitations

The settlement establishes $5.5 billion in criminal fines against Purdue Pharma. Contudo, there is a controversial aspect: a large part of this amount will not actually be paid. A previous deal reached in 2020 with US Justiça’s Departamento drastically reduced what the company will actually shell out. The agency will only collect US$225 million in criminal fines, highlighting the limitations of legal processes when large companies structure their defenses through negotiations.

Essa disparity between the sentence amount and the actual amount charged generated criticism from activists and victims. Para many, the punishment does not adequately reflect the magnitude of the harm caused. The dissolution of the company and the payment of compensation, although significant, leave questions about individual criminal liability of the executives.

Fundo for victims and compensation

Parte’s substantial settlement was directed toward assisting individuals directly affected by the opioid epidemic. A US$865 million fund was created specifically for this purpose. The resource will finance treatment programs, psychological support and compensation for victims of addiction, as well as family members of people who died from overdoses.

Esse mechanism recognizes that the opioid crisis has generated immeasurable human consequences. Entire Comunidades were ravaged by addiction. Crianças were orphaned. Famílias lost savings. Cidades saw healthcare infrastructures overwhelmed with overdose-related emergencies. The fund, although it can never fully compensate for these losses, offers concrete resources for recovery and reconstruction.

Contexto of the epidemic in Estados Unidos

The American opioid crisis began in the 1990s when the pharmaceutical industry stepped up marketing of opioid painkillers, claiming they were safe and appropriate for chronic pain. Purdue Pharma led this movement with OxyContin, positioning it as a revolutionary solution. Médicos, influenced by aggressive campaigns, increased prescriptions. Pacientes have developed dependency. Quando addiction deepened, many sought heroin on the illegal market, which was cheaper and more accessible.

The consequences were disastrous. Centenas of thousands died. Economias sites collapsed under public health and safety costs. Sistemas of education and social welfare faced extreme pressure. The epidemic exposed regulatory failures that allowed a company to put profits above public safety for two decades.

Dissolução and corporate future

The decision to dissolve Purdue Pharma marks the closure of a company that has operated since 1892. Seus assets will be liquidated to honor the judgment. Embora dissolution does not bring back lost lives or undo family traumas, it symbolizes corporate accountability through legal mechanisms. The company will not continue to generate profits under the same name or structure.

Executivos’s key Purdue Pharma faces personal questions about criminal culpability. Alguns were criminally prosecuted in specific jurisdictions. Outros negotiated reduced sentences. Justice, for some observers, remains incomplete as long as individuals who made specific decisions do not face imprisonment commensurate with the harm caused.

Precedente regulatory and future

Este case sets important precedent for pharmaceutical regulation in the US and internationally. Demonstra that companies can be held liable for regulatory fraud and harm to public health through civil and criminal litigation. Contudo also exposes limitations: the ability to negotiate reduced penalties, the difficulty of extracting full reimbursement, and the frequency with which corporate liability does not translate into severe individual criminal liability.
