Comissão Nacional of Mercado of Valores Mobiliários (CNMV) of Espanha condemned former player Gerard Piqué and businessman José Elías for trading stocks based on confidential information. The fines totaled 300 thousand euros, with Piqué receiving 200 thousand and Elías, 100 thousand. The cases involve 2021 transactions related to medical company Atrys Health.

The irregularities occurred when Piqué acquired 104,166 shares of Aspy Global Services after receiving confidential information from Elías, its largest shareholder. The former defender of Barcelona sold the shares days later, on January 27, 2021, making gains in the operation. Ambos were classified as “very serious” offenders, the regulator’s maximum classification.

The events that generated the sanctions occurred during a specific operation by Atrys Health to acquire Aspy Global Services. The company Aspy operates in occupational risk prevention and corporate health services. Elías, as the main shareholder, had access to non-public information about the negotiation before its official disclosure to the market.

Piqué used this confidential information to make investment decisions. The purchase of shares took place a few days before the sale, constituting a short-term operation taking advantage of privileged knowledge.

Gravidade of infringement

The use of privileged information represents one of the most serious violations in the Spanish capital market. Essa practice compromises equality between investors and violates fundamental principles such as transparency, integrity and fairness of the financial system. Reguladores consider such conduct to be detrimental to public confidence in stock exchanges.

The sanctions applied by the CNMV reflect the seriousness with which the regulator treats this type of behavior:

  • Multa to Piqué: 200 thousand euros
  • Multa to Elías: 100 thousand euros
  • Classificação: very serious infraction
  • Transactions Período: 2021
  • Empresa involved: Aspy Global Services
  • Related Operação: Acquisition by Atrys Health

Resource Possibilidade

The decision is final at the administrative level, but both have the right to appeal to the Spanish Tribunal Nacional. Esse’s appeal opens up the possibility of judicial review of the sanctions imposed by Comissão. Segundo information available, Elías alleges that the decision arises from the illegal disclosure of relevant information before its proper publication, which could support arguments for contestation.

The administrative process has already gone through the investigation and trial phases within the CNMV. Agora It is up to the courts to assess whether the evidence supports the accusations and whether the fines correspond proportionally to the damage caused to the market.

Contexto professional

Gerard Piqué ended his career as a football player and became involved in business activities at Espanha. Atualmente, owns the Andorra football team and invests in several sectors. José Elías is a businessman with relevant stakes in companies such as La Sirena and Audax, in addition to Aspy Global Services.

The investigation that resulted in the fines lasted approximately three years, from the 2021 transactions to the 2024 decision. The CNMV used its supervisory powers to track suspicious transactions in the Spanish stock market and identify potential violations of investor protection rules.

Esse case reinforces the Spanish regulator’s commitment to curbing illegal practices in the securities market and maintaining the integrity of financial operations. Investidores and companies should be aware that European regulators are intensifying oversight of transactions related to insider trading, especially involving people of public notoriety.
